Leading family law and divorce expert Fiona Sasan on why legal clarity is a form of self-care
In my work as a family lawyer in Scotland, I regularly meet women who have compromised their lives due to overwhelming anxiety around the unknown. It might be uncertainty about finances after a separation, or concerns about what would happen to the family home. Sometimes it’s questions around childcare arrangements, or the reality of living with a partner without being married. Lives are not lived how they should be if they are paralysed by fear.
Without clear information or agreements, it’s all too easy to catastrophise – compromising your own life because you believe you have no other choice:
- What if I’m left with nothing?
- What if I can’t stay in the house?
- What if we can’t agree about the children?
This uncertainty can create low-level constant stress, affecting sleep, concentration and overall wellbeing. It crushes happiness and hope.
Why clarity changes everything
One of the most powerful shifts I see in clients is not necessarily when a situation is resolved, but when the way ahead becomes clear. Plans can be made. Hopes and dreams rekindle.
Understanding your legal position in Scotland – whether in relation to separation, cohabitation, finances, or parental responsibilities – brings something invaluable: certainty. And certainty reduces anxiety.
Putting agreements in place can feel daunting, but in reality, it often brings immediate relief. This might include:
- A written parenting arrangement that sets expectations and reduces conflict
- A financial agreement following separation, providing clarity on assets and support
- A cohabitation agreement that protects both partners and avoids future disputes
These steps are not about expecting the worst. They’re about removing the “what ifs” that quietly drain emotional energy. It can also ensure you don’t compromise things that are critical for the future but which you may feel are easier to surrender due to being in flight mode. Clarity doesn’t just protect you legally – it creates space mentally.
Real lives, real relief
While every situation is different, certain themes come up time and again. Lawyers don’t just advise on legal entitlement. They help create pathways for you to take your life forward – where a future can be seen based on sensible advice, which provides a stable foundation whereby life can be rebuilt. Lawyers can release the paralysis that can set in with such overwhelming life changes, so don’t fear them. Choose wisely and they can be your best ever purchase.
